Greetings List -

A law school colleague of mine has reached out asking for a referral. The TL;DR version is homeowner cut down trees to improve their view despite the fact that HOA/Community said no.

Longer version: A couple years ago, my friend was motivated to join her HOA board because of the fact that trees that had been in place since the original development of the property (and were in place when the house was purchased) were growing up and were going to be blocking part of a particular homeowner's view.  The community has, on multiple occasions, voted for board members who have kept the community as it was with these flowering trees lining the public play space as part of the character and beauty of the neighborhood.

Yesterday, the homeowner elected to take the situation into their own hands and cut down the four trees that they wanted removed.  The trees are literally laying in their backyard (photos have been obtained).

They are looking for an attorney who can represent the HOA in this timber trespass matter. They believe that this case is ripe for the treble damages - in addition to the cost of replacing mature trees - due to the premediated actions through years of trying to get people on the board who would come in and chop the trees down.

The neighborhood is located in Kirkland (east side of 405).

All referrals will be passed along.
