Your client can open the probate if the widow is not wanting to do that and give the widow notice of the probate being filed in Washington.  If more than 40 days since death, the widow (who would have had priority in serving as PR/Admin), the son can file and ask to be appointed.  You did not indicate if there was a Will naming a PR and if yes, that person would be appointed if they come forward.  Once Letters are issued and probate is opened, that person can obtain the EIN number.

Greetings,

I have an out of state, married, beneficiary who died after his father.  We are now seeking to wrap up the estate (sale of real property) for the father but the widow has not initiated a probate or obtained an EIN number for her husband’s (beneficiary’s) estate.

How have others dealt with this?  There are capital gains to contend with and I would like the beneficiaries to handle that rather than the estate – so we need the EIN.

Thoughts?
