[WSBARP] Stipulated Eviction/Ejectment

Don’t do it. You’ll just legally empower a squatter with nothing to lose and eventually wind up a long and pointless battle with “tenant’s rights” lawyers for nothing. Eject them yesterday. Why would you even consider giving a squatter two years—what’s the upside to the estate?

Subject: [WSBARP] Stipulated Eviction/Ejectment

Greetings List Members -

I have a very ugly probate that has popped a real property question.

Can someone who is currently squatting in a residential home without legal authority to stay, be allowed to stay for a fixed period of time, pay the Estate an agreement amount, covering utilities etc, but also then agree that if they do not vacate by June 30, 2026, that the Estate can bypass a formal eviction process and enter a stipulated order for a writ of ejectment?

Appreciate any guidance.

Brent
