Correct. In most cases, short-term rentals would be considered a residential use. However, the Chiwawa court allowed that, depending on the circumstances, short-term rentals could be a commercial use.

If a community wants to ban hotel or transient use of the units/lots, a declaration amendment prohibiting rentals for fewer than a certain amount of days is the way to go.

Its not as clear where in addition to rental and use of property other services are provided such as meals and recreational activities.

Bryce, take a look at Wilkinson v. Chiwawa Communities Ass'n, 180 Wash. 2d 241, 327 P.3d 614 (2014).

TL:DR - Short-term rentals are a "residential" as opposed to "commercial" use for purposes of restrictive covenants.

If the covenants of the homeowners association prohibits businesses, but has no restriction on short term rentals is conducting an Airbnb on your property, considered a business that is restricted by the covenants or is it just a short term rental which is not restricted your input would be appreciated. Bryce, since B&O taxes are due on the revenue generated by the Airbnb
rental, I bet a court concludes it is a business and thus barred by the
covenants. But ambiguous, indeed!

A former client's son has been arrested for DUI. I am not familiar with the practitioners in that area as I used to be. Any reccomendations would be welcome. Parents are hispanic immigrants, son is US-born.
So Spanish isn't essential, but might help since I think the parents will be helping with the funding.
