As long as it is an allowed density there should be no issue. I have done lots of airspace condos. A condo does not have any effect on what can be built, just ownership.  If you are allowed to build 4 detached units then you should be able to record the condo before or after  construction.  Often detached is not allowed so attached is built then a condo  created. Post construction avoids discrepancies between the survey and actual location of party wall.

Are you building a second residence on the property like a ADU? You may be able to condo the property if that is the case.

City will not allow a subdivision. Is there a way to segregate the LLC from the personal residence so that the residence is not treated as an LLC? Renting from the LLC has its own set of difficulties.
