Thanks Eric,
We will make the claim for the client and see if the Debtor responds. The
interesting twist is the judgment is for a water district so I can make the
pitch its claim is not subject to the homestead, if he even responds. Yes,
I read the statute and will serve everyone who received the notice.

See attached, which I developed for a case I had last year. These don't
address a potential homestead claim though, because it wasn't an issue in my
case. Be sure to serve notice on each and every address that received notice
of the foreclosure-see the requirements of the statute cited in the motion.

Client has a judgment against a person who's home was nonjudicially
foreclosed. There were excess proceeds paid into court. Does anyone have
pleadings they have used to make a claim against these proceeds? Also, I
assume the debtor can make a homestead claim against the proceeds.
