Subject: [WSBARP] Odd contract provision

Listmates,  I have come across an odd construction contract provision and would appreciate thoughts.  Contract says that Contractor has 365 days to cure a breach or begin to cure a breach.   Contractor took the full payment, tore the house apart ( unlivable) and now is unresponsive and no work for a few months.   Anticipatory breach or repudiation?   Any thoughts about getting around an obviously egregious provision?  Thanks in advance.   Craig
