[WSBARP] Fireplace in rental

Listmates. A client called and wanted to know if they are required to repair a wood burning fireplace in the rental home or can they just tell the tenant not to use it.  One argument it is an appliance an must be replaced, another would be it is not a "certified" unit and therefore can't be used due to air pollution.  Thoughts?
