[WSBARP] UD and Atty Fees after Voluntary Dismissal

Listmates, I am seeking points and authorities resisting a tenant's request for atty fees after the LL brought a CR41(a)(1)(B) voluntary dismissal.  Dismissal was granted after the judge ordered the parties to trial but prior to trial.  Need to overcome Council House v. Hawk.
