Dear John:
John McCrady just responded to a similar question about the applicability of the Garn+St. Germain act and quoted a section that prohibits the enforcement of a due on sale clause when the transfer is to the child of the deceased mother. I think the lender is prohibited from making the daughter refinance the property.

I have a client who was placed in title to her mother's home under a TOD deed after the mother passed away.  The property is subject to a mortgage, and the bank wants the client to apply for a refinance and pay a sizeable down payment.  Is there authority in the area for TODD transfers and existing mortgages?
