Subject: [WSBARP] FW: Title Insurance and Unenforceable Deed of Trust

I have a case involving the clearance of an old deed of trust that was never reconveyed.  The maturity date was 9/1/2005 and the seller is certain the note was paid off.  I approached Old Republic Title about insuring around the DOT based on the expiration of the six-year statute of limitations and non-enforceability of the DOT based on the recent case of Eng v. Specialized Loan Servicing, Case No. 82378-7-I, Washington Court of Appeals, Division One, filed December 13, 2021. ORTC declined and invited us to search for another title company in lieu of commencing a quiet title action.

Has anyone had success with any title company on this issue?
