List members,
I am having trouble finding a notary that understands the law and is willing to take an acknowledgment of a lease that has already been executed. Even pointing them to the RCW and DOL’s Notary Public Guide does not seem to help.
https://www.dol.wa.gov/business/notary/docs/notary-handbook.pdf, which states… “A notary who takes an acknowledgement confirms that the person before them was the signing party on a document that has already been signed. In this case, the notary has to confirm not that the document is being signed during the notarial act, but that the document was signed in the past and that the signing party before the notary was the signing party for the original signature.”
Does anyone have a referral for a notary with a remote notary endorsement that understands the law and their duties and their authority to take an acknowledgment of a signed lease? Thanks.
Sam
