[WSBARP] PC - Mortgage Company/Insurance Issue (House Fire & Re-Build)

Dear RPPT Listserv:



PC is a relative of mine, and property is in Grays Harbor County.  PC’s
home was destroyed by fire about 1 1/2 years ago.



PC and his family have lived with relatives while PC has been working on
re-building the house.  The re-build now is well into process, the
insurance company has sent checks to PC in the name of PC and mortgage
company, which PC immediately endorses and sends on to the mortgage
company.  So far, PC has sent on about $170,000 in insurance checks to the
mortgage company, but the mortgage company has only sent checks totaling
about $50,000 of that money back to PC to pay for the re-build.



The mortgage company has been demanding extensive paperwork and releases
for each check it sends PC (which PC immediately provides), and the
mortgage company is untimely and uncooperative with releases of funds to
pay the construction for the re-build.   To keep the re-build going, PC has
drained about $250k in savings and other sources to pay contractors up
front while waiting for mortgage company to send back the insurance
proceeds to PC.  PC has been handling this directly (no legal assistance)
until now, but it appears the situation has reached a wall with these
mortgage company folks and their bureaucracy.



To add to it, the insurance company has stated that this claim will be
closed May 13th, which is problematic because the re-build is slow to
proceed due to mortgage company not paying the insurance proceeds (only
about 50% of what entire claim should be has been paid out by insurance
company to date).



Mortgage company is “Newrez” and Insurance Company is “Country Financial.”



Any advice on what kind of legal practice area this falls under? Any takers
or recommended referrals?  I will pass on all names/contact information.
Time is of the essence to this PC.
