Listmates,
This is really a title insurer question. Client's spouse passed. Client
could not find the original community property agreement. We, therefore,
recorded an Affidavit of Lack of Probate which included the Death
Certificate and the Decedent's Will that left everything to Client. I,
believe, that will be sufficient to clear title to Client's home. Of
course, Client now finds the original CP. Do I now need to record the CP?
THE ALOP was recorded just under a month ago and the County Assessor has yet
to pick it up.
