[WSBARP] Recording a Judgment

I've always wondered about that case.  If the judgment had been recorded 
then one of two situations would have been present:  (1) There would 
have been no equity above the homestead amount and the lien could have 
been avoided under 522(f); or (2) It would have been preferential and 
the trustee could have avoided it, stepping into the shoes of the 
judgment creditor for the benefit of all creditors.  Any harm to the 
judgment creditor would have been minimal unless they were the main 
creditor in the case, or non-existent if there were priority creditors.  
I just don't see how those facts give rise to much of a malpractice 
claim. If 90 days had passed the result would be different, but not five.
