Client's house plans are over 100' back from high bluff.  Client gets County approval for location and, at least, two inspections are done to verify house is over 100' back from high bluff.  But, then a small portion of the bluff sloughs off onto the lower beach sometime last year while client is pouring the foundation and builds out house.  Client tries to get the final permits for occupancy and new county inspection says no, too bad, so sad, you are within 100' (by 6 inches) feet of the bluff and now can't move in until you do a bunch of geotech studies, etc.  At what point is a citizen vested in building a house under changed circumstances during the course of construction.  Client has contacted several Geotech professionals and they have all declined to do a survey because, they say, the county is trying to pass potential liability from the County to the geotech professionals.  (Please, no comments on whether client should build there.  He acknowledges the risks.) Any guidance on where to look to answer this question?
