Clients just discovered their property is subject to a Notice of Latecomer Charge recorded on May 22, 2001. The Notice states it will terminate February 11, 2025. In 2001, the relevant statute (RCW 35.91.020) appears to state such notices could not exceed fifteen years. Is the 25-year Notice period lawful? Is a better statute on point?
