Nicholas,      Be careful. You do not want the properties combined in the eyes of the county. There would be a significant  loss in value. In Mason County, they have been using every excuse to say lots are combined. I would use separate deeds since the extra cost is nominal. It may be totally unnecessary depending on what your county is doing. But things change. An ounce of prevention.........

Listmates, 

 

PC is a retired home builder (was licensed, bonded, etc).  They buy a "nice"
home and move in.  Then things start falling apart, so being a home builder,
he fixed the problems as they appeared.  In the end, he "woke up" and
realized he had remodeled most of the house.  This included installing new
wiring, plumbing, flooring, etc.  No permits were obtained, or permit fees
paid.  He has pictures of wiring, plumbing, before covered up.  

 

He wants to know what would happen if he went to the building department,
now, and attempt to obtain permits for the work.  In the past, at least with
foundation work, inspectors would accept pictures, after the fact, showing
re-bar and other work before the foundation was finished and approve the
work.  Is that so for electrical and plumbing?

Jeff: I think such response is entirely dependent on the county or city permit department; how kind or obtuse they are and how apologetic your client is.

Depends on the jurisdiction, and what their practices, procedures, and
policies are.  This is not an uncommon issue.  Many small to mid-sized
jurisdictions leave electrical code enforcement to the state department of
Labor and Industries.  See also WAC 51-16-080 (12).  Single family residence
is R-3.  Flooring is typically considered finish work.  Be careful of
fireplaces and stoves, that is where a lot of problems lie.

Would anyone be willing to share with me a usable format of an Irrevocable
Trust that is from the Grandparents for the benefit of a Grandson.  The
idea is to provide for his "health, welfare and education".  I realize that
there are many variables to work through with my client.  However, a good
model would be very much appreciated.

I don't need a format specifically for a grandparent to grandson.  Parent
to son will work.  I can make the adjustments.

Now we want to transfer these parcels to a Living Trust. Can I transfer all of the parcels by a single quit claim deed? Are there any restrictions on this? Must they be contiguous? Property is in Spokane County, if that matters. Thanks for your help!

I see no reason why all properties couldn't be transferred in a single deed; just be sure to list all parcel numbers in the deed index. They need not be contiguous but they should all be in the same county (which is not a technical requirement but it is a lot easier for recording purposes to use separate deeds for each county).

As long as all the properties are in the same county you can use one deed.

I see Trust Transfers all of the time with one deed and multiple properties.
They need not be contiguous.

This seems like a ripe area for new 'clerk policies' requiring fees for each parcel; better hurry before they decide they 'need' more money.

Hi,
I have a fairly straightforward question. Client has acquired multiple adjacent parcels via different deeds (some came in by Quit Claim Deed from family, others by Statutory Warranty Deed by purchase). Now we want to transfer these parcels to a Living Trust. Can I transfer all of the parcels by a single quit claim deed? Are there any restrictions on this? Must they be contiguous? Property is in Spokane County, if that matters. Thanks for your help!

I believe you would need a separate excise tax affidavit for each parce although one conveyance document

I can see no reason not to use one deed to convey all Spokane County property owned by client into the living trust.  This is true whether contiguous or not.  The client doesn't need to pay the extra recording fees....

Do they even need to be in the same county (assuming the grantee doesn't 
mind recording delays)?

I vaguely recall a case involving a mortgage where the parcels were not 
all in one county.

I have done several parcels on one deed but they were contiguous.  The excise aff has several lines for parcel numbers.
