Dear Paul:

I pick your option A. For the revocation to be valid, you may not execute the revocation prior to execution of the TODD. But I can envision scenarios in which the timing and the execution and the recording of each could be problematic.

Subject: [WSBARP] Revocation of TODD Form

Anyone have a template or form for a WA Revocation of Transfer on Death Deed? It should be easy but then the statute (RCW 64.80.080) says that it is effective if the instrument "Is acknowledged by the transferor after the acknowledgment of the deed being revoked and recorded before the transferor's death in the public records in the office of the county auditor of the county where the deed is recorded." Huh?!?!? Is this just a lousy way of saying that the date of the revocation must come after the date of the original TODD? Or is this saying the transferor must sign and acknowledge the revocation twice?
