[WSBARP] Equity Sharing Agreement and Tenancy In Common Agreement

Hello Learned Listservers:

 

I had two quick requests for help/ assistance. 

 

1.	Equity Sharing Agreement.  I have a potential client that appears to
need an equity sharing agreement.  If anyone has a template that they could
share with me, I would really appreciate it.  

 

2.	Tenancy in Common Agreement.  I have another group of potential
clients that are seeking a tenancy in Common Agreement.  It is a group of
people and so I am leery of representing them all.  They want to hold a
single property (a house) as a group and define each parties duties and
responsibilities.  I'm unsure if the best approach would be to have the
parties form an LLC and transfer the property to the LLC (which could
trigger the due on sale clause in the deed of trust) or simply ask the
parties to all sign a tenancy in common agreement.  Any advice is
appreciated.  Further, if anyone has a tenancy in common agreement template,
this would really help me out.
