When you say it like that, you make her position sound unfair. He is not going to like hearing the limited rights he has as a tenant in common, with no contribution obligation. Yes, her rights as a tenant in common start at half, but she also can trade his duties to pay rent against his claims for maintenance. T-I-C with an ex -girlfriend can be more inequitable than a marriage dissolution.

I’d appreciate it if someone on the list serve would send me some cites dealing with a partition action where title to property was taken in name of my client and his then girlfriend who lived in house for 3 years then she voluntarily  left she  made no contribution to house payments nor assist in making substantial improvements to the house during her occupancy because she said it was his house and therefore she wasn’t responsible to share in costs and now that she has moved out she wants  one half of equity.  Thanks for your help
