Listmates - The Governor's Proclamation dated 4/16/2020 provides a
restriction against a commercial landlord raising the rent, but contrary to
residential leases the order does not appear to restrict taking action in
the event of a tenant's failure or refusal to pay rent, such as serving a
notice to pay rent or cure a default or vacate, nor does it appear to
prohibit serving a summons and complaint for unlawful detainer. Of course,
there is the practical issue you cannot currently obtain an eviction order
from the courts. Does anyone have a contrary opinion regarding this
procedure? Thanks for any comments.
