Yes they can charge fee and by explicit agreement use deposit funds, and they must still follow deposit return rules. 

Even in a market where it’s easy to find tenants, A termination fee equal to one or two months rent is perfectly reasonable. There are risks and costs associated with letting a tenant out of the lease early.
