See RCW 64.34.320 if agreement entered into by Declarant and not by Bd elected by members and also RCW 64.34.080 dealing with unconscionable contracts of which this clearly falls under that category.

Subject: Re: [WSBARP] Comcast Questions

Condo association is in year 8 of a 20 year agreement with Comcast.

The agreement has exclusivity type language, e.g. “association shall not contract with another provider of services…”

I understand the FCC has ruled exclusivity provisions as unenforceable.

Comcast rates are significantly greater than competition.

Anyone have experience in negotiating reduced rates with Comcast on bulk services?

Any experience in having Comcast seeking to enforce the exclusivity type language?

Thanks and enjoy the weekend,

Ron
