[WSBARP] Insurance Policy pay to set up probate ?

Hi Everyone,

We are setting up probate for the estate of decedent who injured our client in an MVC, and the question is if the  insurance policy, which seems to cover legal fees re estate administration, must pay to set up the probate.  We don't represent the client in the PI case.

The relevant language is:

if the insured named in the Declarations or the spouse of the insured resident in the same household dies, the
policy will cover:
a.             The survivor.
b.             The legal representative of the deceased person while
acting within the scope of duties of a legal representative.
