It is understandable, since the issue becomes whether the deed was delivered prior to death and the person who would “swear” to delivery prior to death is typically the grantee in the deed.

Title companies will not insure a conveyance is effective if it is not delivered during the lifetime. It is treated like a draft of a future Will; totally irrelevant.
