[WSBARP] Sanitary sewer easement

Use: It is not uncommon for a benefitted parcel to want to add another
utility (telecom is typical) at a later date.  If there is a potential need
for electricity, to run a grinder pump for example, then that should be
addressed.

 

Latecomers: if there is a chance the sewer line will be used by an
additional party at a later date, such as an adjoining property, then that
should be addressed.  I have had instances in which these private sewer
lines are extended over time to run about a mile, and eventually cross a
dozen properties, so beware if this is in a rural or semi-rural area.  This
can be especially problematic if the line crosses a critical area that was
not designated when the line went in.

 

Unintended spills: sewer lines have a life span, and when it fails, the
burdened property will wish to be held harmless from leaks.  

 

Notification.  Burdened property owner will want to be notified when work is
to be performed (including notification of maintenance work), and will want
the easement area cleaned up and restored.
