[WSBARP] 709 filing for person who is living in Mexico but is a citizen of Canada, for property in Seattle

Help.

Client is dealing with property in Seattle.

Name on deed is ex [but never legally married] of client.

Person on the deed [ex]  has signed limited POA for client to transact  the property as needed.

If the property is quit claimed, as gift,  for instance, now, and assume REETA and supplemental are properly completed... and, ex is not required to file a tax return in the US - what is required so that client does not risk a tax penalty if the 709 is not filed?

The reason to QC now is:

1] avoid  title company saying a 4 year old [or older, depending on when property sells] SPOA is no longer acceptable, and
2] to ensure there is no need to make contact with ex at a later date... right now things are good, in times past, things have not been good. And the geography is unpredictable.
