Good afternoon,

I am aware that, as the Washington Condominium Act did, WUCIOA requires certain sellers to “provide” a POS to prospective buyers and requires that the POS “include copies” of certain documents.


1.    Is “providing” the POS by directing buyers to a website from which they can download it considered sufficient?  (Suppose the PSA gives buyers an opportunity to request hardcopies instead, and that the PSA includes language indicating that, unless the buyer has requested a hardcopy of the POS in the PSA, seller will notify buyer of any material updates to the POS by some specified method).

2.    Is it necessary to attach to the POS the various documents the declarant is required to “include,” or can the documents be referred to in the POS and included as separately downloadable documents on such a website?
