The short answer is no; these matters would not be deleted except on a case by case basis and after careful analysis of each in the circumstances.

Title Gurus,

Most of the title work I do is on deals in Montana, but I have one in Washington deal right now.  I am curious to know if a “customary” owner’s affidavit in Washington would cover the below exceptions.

Schedule B, General Exceptions


  1.  Exception F

     *   Any lien for services, installation, connection, maintenance, tap, capacity or construction or similar charges for sewer, water, electricity, natural gas or other utilities, or for garbage collection and disposal not shown by the Public records

  1.  Exception H

     *   Reservations and exceptions in United States Patents or in Acts authorizing the issuance thereof
  1.  Exception I

     *   Indian tribal codes or regulations, Indian treaty or aboriginal rights, including easements or equitable servitudes

Schedule B, Special Exceptions


  1.  Exception 3
     *   Any service, installation, connection, maintenance, construction, tap or reimbursement charge/costs or assessments for sewer, water, garbage, electricity or road improvement that is not of public record


  1.  Exception 28
     *   Referring to underwiring approval and further requirements
