Jeff, please call tomorrow. This is the sort of thing I do often, and it all
really depends on the language of the governing documents and the
willingness of the court to try to understand what you are doing. I tend to
favor, where supported by the governing documents, going fast and hard.

List mates, 

 

Home within a homeowners association was abandoned and then foreclosed on.
Before the foreclosure, squatters broke in and violated numerous CC&R’s.
Their activities resulted in numerous police and sheriff visits including
one by the local SWAT team.  But this led to only one arrest and they
remain.  The foreclosing lender was notified about the problem but did
nothing.  The foreclosure purchaser is a V Mortgage REO 2, LLC which is
registered in Delaware with no company addresses. It’s contact information
is a National Registered Agents, Inc., which itself is registered in DE, and
in Washington with CT Corporation as its local agent.  V Mortgage is not
registered in Washington and its real property tax statements are sent to
Shellpoint Mortgage Servicing out of Greenville, SC.  

 

Pursuant to the CC & R’s, V Mortgage has been notified, through its
registered agent and Shellpoint, of the situation and a thirty day demand it
stop the violations or the association will take remedial action and assess
the costs against the property.

 

Assuming V Mortgage does nothing,  how can the association remove the
squatters?  The Association has the authority to enforce the rules, but does
it have authority to seek injunctive, or other, relief that allows removal
of the occupants?  Is it limited to a “large” special assessment and then
foreclosing its lien?  Your thoughts would be welcome.
