Yagotta see the trust language; it could easily say that surviving spouse's don't get anything from the trust.

Listmates:

Clients husband passed away in September 2015. Husband was in trust with brother and sister of property that's worth significant amount of money. Trust was created in 2008.

After death of clients husband brother takes upon himself recreating a new trust with his lawyer naming himself and sister as new trustees only. Excluding the deceased brother. 

In 2008 trust quiet about surviving spouse. However my clients husband will which is in probate clearly states that she is entitled to all of deceased husband property.

Thoughts on this issue.
