[WSBARP] Foreclosure Loan Mod Question

Good morning All,

I have a foreclosure related question:

Lender issued Notice of Default Dec 20, 2016. Borrower requested mediation. Lender and borrower came to a forbearance agreement in lieu of mediation. Borrower failed to honor the forbearance agreement terms, so the mediator issued a Certification in September 2017 with "Borrower Not In Good Faith (RCW 61.24.163(15))" checked with the explanation "Borrower has failed to honor the forbearance agreement."

Lender is now moving forward with foreclosure. Foreclosure is set for February 2018, but Borrower has hired a CA law firm to possibly apply for another loan modification.

Is there any state or federal law that says lender is obligated to review a loan modification at this stage?

Thank you in advance for your help.
Kim
