To the Condo Gurus

 

RCW 64.34.344

Tort and contract liability.

Neither the association nor any unit owner except the declarant is liable
for that declarant's torts in connection with any part of the condominium
which that declarant has the responsibility to maintain. Otherwise, an
action alleging a wrong done by the association must be brought against the
association and not against any unit owner or any officer or director of the
association....

 

 

In theory any act by an officer or a director is on behalf of the
Association.

 

Does the highlighted language preclude any actions by an owner against a
condo association officer or director except perhaps  "intentional
misconduct.. or a knowing violation of law, ..or for any transaction from
which the officer/director will personally receive a benefit in money,
property, or services to which the officerdirector is not legally
entitled.."
