Shooting from the hip here, but have you considered a quiet title action and serve the IRS?

Subject: [WSBARP] Third Party Application for Discharge of IRS lien?

Good afternoon,

Has anybody had experience doing a third-party application to the IRS for a lien discharge?

Client purchased real property at foreclosure auction. Client later discovered there was an IRS lien on the property. The IRS has a 120 day right of redemption following the sale. We applied for release of right of redemption. It turns out the Trustee did not provide appropriate notice to IRS before the sale, which means the encumbrance will stay attached.

I was informed Client would have to do an Application for Discharge of lien, which is a different process. Has anybody had experience with this when applicant has no relationship to the liable taxpayer? Previous owner is in the wind. Would anybody be available for a short phone call to talk through the process?

Best Regards,
