Unfortunately she didn't have that ins.and the HOA condo ins. coverage doesn't extend to floor coverings or wall coverings.

Isn't this damage that would be covered by the Seller's homeowner's insurance.  Perhaps suggest that the Seller make a claim, pay the deductible and assignment their interests to the Buyer?   You will need to review the policy to see if assignment is possible without voiding the coverage.  This is one option to explore, and perhaps only a partial solution.

Subject: [WSBARP] Refusal to repair

Parties sign form MLS purchase and sale agreement. It provides that the seller will maintain the property in same condition normal wear and tear excepted. Prior to closing refer leaks and hardwood floor is damaged. Seller wont repair no ins to cover it buyer willing to closes if seller repairs or deducts estimated cost of repair from purchase price. Can buyer require seller to repair and if seller refuses close  sue for damages or in alternative sue for breach of agreement? Your input is appreciated.
