[WSBARP] Refusal to repair

I think if Buyer closes it would most likely waive the breach, so there would be no remedy. Safer to go the other route, and get a credit against purchase price, or delay closing until the work is actually done.

Parties sign form MLS purchase and sale agreement. It provides that the seller will maintain the property in same condition normal wear and tear excepted. Prior to closing refer leaks and hardwood floor is damaged. Seller wont repair no ins to cover it buyer willing to closes if seller repairs or deducts estimated cost of repair from purchase price. Can buyer require seller to repair and if seller refuses close  sue for damages or in alternative sue for breach of agreement? Your input is appreciated.
