[WSBARP] Suit by Assignee

Hello fellow listmates. I hope someone can answer this question for me.

Quick Facts: My client won case at 9th circuit against an appraiser and
received a judgment. Appraiser's insurance company denied coverage of
the judgment amount under the E&O policy. Appraiser has no money. Appraiser
assigned the right to go after the insurance company for bad faith to my
client.

My question: Who is the plaintiff? The client-assignee, the
appraiser-assignor, or some combination? Besides having a valid assignment,
is there anything else we should do before filing suit against the
insurance company?
