Subject: Re: [WSBARP] condo skylight issue

A skylight is a window located in a roof as opposed to in a wall. If this
is a new act condo, the skylight is a limited common element. If it is an
old act condo, the skylight is part of the common areas and facilities. The
question of maintenance would depend on how the declaration treats
maintenance of windows.

Subject: [WSBARP] condo skylight issue

Does anyone have experience with/authority regarding whether a skylight in a
condo is considered part of a roof and therefore common property, or if the
skylight itself is considered only the property of the unit to which it is
attached? Relevant for maintenance liability issues.

Thanks,
