The FDIC website has a list of all banks to include when they opened, closed, if/when they changed their name, when they merged with another bank and the new name for the merged bank, and current contact info.  Maybe Wells Fargo acquired Transamerica, and this can be shown on the list to connect the two – assuming Wells Fargo was not simply the loan servicer.  Not sure if this helps, but it may assist if you can’t locate Transamerica.  I would assume there is an argument that the 6 year statute of limitations on the DOT has expired if client hasn’t made payment on any mortgage on the property since 1998 (see RCW 7.28.300).

I am doing a real estate closing for an investor client and the preliminary commitment reflects an un-reconveyed 1987 note and deed of trust for the benefit of Transamerica Industrial Loan Company.

The only documentation I have reflects a payoff to Wells Fargo in 1998, but the WF payoff does not reference the property nor is the WF account number tied the property nor Transamerica.

The title company is requesting documentation or information which would link Wells Fargo to Transamerica for purposes of having them insure around the 1987 deed of trust which was never reconveyed.

Also, there is no recorded assignment between Transamerica and Wells Fargo.

Thoughts?
