[WSBARP] Probate & Appeal Question

I have my own answer on this but I want yours too.

Case pending while person is alive resulting in adverse order.  Appeal is taken.  In interim, person passes.  Appeal still pending.

Do we need to substitute the estate in?  Do we need a probate here?
