Concerning Guardianship and Texas Foreclosure, it does not sound correct to me, but hey I could be wrong that the King County Probate would be involved.  Second opinion could probably be had from Texas firm I am acquainted with since I am Board Certified in Family Law also in Texas. New comer to WA license. The Attorney in Texas is Don Duane Ford III Board Certified in Estate Planning and Probate in Texas, of the firm of Ford and Bergner LLP.  Mr. Bergner is well acquainted also with property law in Texas. Just a thought.

A Texas commercial bank is looking for counsel to file a motion in a
pending King County guardianship to allow the Texas commercial bank to
commence a foreclosure upon Texas property held by the guardianship
estate.  Apparently, under Texas law before a creditor can commence a Texas
foreclosure that they have to obtain leave of the guardianship court (no
matter where situated) before they can commence the foreclosure.



Just looking for names to forward to the Texas bank officer. Long time
on/off REO client of mine.

When the Snohomish County Sheriff issues a sheriff's deed after a sheriff's
sale, it is not acknowledged.  

And yet, "[e]very conveyance of real estate, or any interest therein, and
every contract creating or evidencing any encumbrance upon real estate,
shall be by deed .."  RCW 64.04.010. "Every deed shall be in writing, signed
by the party bound thereby, and acknowledged by the party before some person
authorized by this act to take acknowledgments of deeds." RCW 64.04.020.  

There is no sheriff's deed statute.  A sheriff's deed has been construed to
be a bargain and sale deed. Graham v. Findahl, 122 Wn. App. 461, 466, n. 5
(2004).  

The deeds issued by the King and Pierce County Sheriff are acknowledged.
But the Snohomish County Sheriff, going back at least 17 years, has been
issuing deeds without acknowledgements.

Doesn't a sheriff's deed need to be acknowledged?  If not, based on what?
If so, why are the title company's insuring title downstream from a
Snohomish County sheriff's deed?

Good morning all,



Wanted to get a sense as to anyone who's had experience on making the
transition from PCLaw to QuickBooks.  Also the pros and cons of using
QuickBooks in lieu of more lawyer tailored billing software.  Have used
PCLaw for the past 12 years (when I left a large firm who also used PCLaw)
and gone through several generations (currently using Ver.12).  Recently
had issue with the fact that I can't reconcile my general bank account
(everything else works).  Worked through all of the suggested fixes (I?m
fairly tech savvy) on their website (also googled it). When I call PCLaw
for service I'm told that I need to pay $550 to ?renew my service plan and
also pay $10/month into the future? before they will give me the time of
day.  To say that I'm frustrated with PCLaw would be an understatement.
Don't need all of the bells and whistles nor case management software.
Just need simple lawyer accounting and billing software.  My CPA does my
state and federal payroll and reporting.



I?ve done lots of research over the years (

I know that most attorneys shy away from QuickBooks due to the fact that
you can have issues with the trust accounting.  Looks like that issue may
now be fixed or there might be some more readily usable workarounds.  I
regularly use QuickBooks Pro for my rental properties so have strong
working knowledge of it.  I'm familiar with the fact that QuickBooks also
forces you to upgrade approximately every three years.



When I look at all of the other attorney billing software out there I see
lots of monthly subscription fees which over the years will quickly exceed
the cost of actually buying it one time.  Also, the fact that you are
parking your billing information up on the cloud as opposed to locally
becomes an issue.

I seem to recall that WSBA did a CLE or has some training modules regarding QB 
for attorneys.  Don?t remember the name of the person who did the training but 
if you dig through the LOMAP link on the WSBA site, you might find something.
