[WSBARP] After Trustee found in bad faith in mediation

Can the Beneficiary foreclose non-judicially again or must they do a
judicial foreclosure? It was my understanding the Trustee could do
another non-judicial but the bad faith certificate was a defense. Can
someone please offer some clarification as I can't find it on Westlaw or
any CLE materials I have. Thanks.
