Josh-  If this deal is in Escrow- the Agent is highly likely to require a
mutually executed termination and release.  I would start there for a form
as most Escrow Agents will not accept silence as an instruction- even if a
deadline has passed under the PSA.

I have a case where the prospective buyer has verbally told the seller
that he has decided not to go through with the sale.  I represent seller.
Verbally propsective purchaser has acknowledged that he will lose his
earnest money.

 

I have seen and used a form for a notice to purchaser that he will lose
his earnest money after ____ date.  I can’t find what I have seen/used. I
didn’t see one in the LPO forms.

 

Does anyone have a form to share for this?
