[WSBARP] Rental Heat ?

Dear Justin: 

RCW 59.18.060 titled "Landlord - Duties." requires that the heating system be maintained (subsection 8), and  in section (11) requires a landlord to "Provide facilities adequate to supply heat and water and hot water as reasonably required by the tenant;"  

Given your facts that there was a space heater, and that it was removed prior to rental, plus the fact that the tenant asked for heat in the room, your client should quickly obtain a space heater and provide it for the tenants.  It's not a cost effective issue to litigate, not likely to go in the landlord's favor, and more expensive to pay your fees than to buy a heater.  A space heater, with enough power to heat the room,  that plugs into an electrical socket in the room is sufficient.

Subject: [WSBARP] Rental Heat ?









List mates:
 
Client landlord has home rented. House is older.
 
The house has baseboard heat in all rooms except the living room area.
 
The landlord had a plug in type of heater that was taken out prior to rental to new tenants.
 
Tenants are requesting that landlord provide heat in the living room area.
 
Is this required that the landlord install heat in living room? Or some other alternative heating?
