Hi Jim,

 

We usually don’t serve as trustee because of the potential conflict of
interest issues that arise.  There’s no strict prohibition against serving
as trustee, however.

I have a client that is asking me to serve as the Trustee of her fairly
standard Special Needs Trust.  Is there any issue with an attorney acting
as such for a client?  This has never occurred to me before.
