Bryce,  Be aware that DOR has taken an insane, aggressive stance regarding
escrow as a legal service.  These bastards audited our firm and assessed
us a 60k tax liability for failure to collect sales tax on the closings.
They demanded access to all our files and billing records both escrow and
legal which I fought them on for 4 years.  The appeals judge determined
that refusing them unfettered access to my legal files and client billings
was a "failure to maintain business records" thus any tax imposed was not
appealable.  The bar association was completely useless in any assistance
in trying to advise the DOR that it was an ethical violation to allow DOR
access to client billing records and files. Their position was completely
unsupported in the law but they consistently interpret green to be red and
black to be orange, as long as the result is a tax liability. I eventually
settled with the thieves because after 4 years it was apparent that they
had all the time and money in the world and we were going all the way with
this case. They wore me down and cost me so much time, staff time and
frustration that letting them steal $20k from my retirement was more cost
effective than spending the next 4 years in litigation.  I will be happy
to discuss the issue with you off list if you are interested.  My opinions

I have always used the title co schedule as a guide for our in house
escrow dept. for residential closings but even if we charge the same as
the title cos or private escrow cos. We can beat their price by 9% since
we don’t have to charge sales tax. For commercial closings or where there
is a business asset sale then we have our own schedule based on time and
amount of sale.

I am getting the distinct impression that title companies are charging a
lot more than we do for real estate closings.  I had a closing fee chart
which I received from a title company years ago, which I have been using.
My lowest fee has been $350 and the chart stops at $210,000 so it is
dated.

 

I was wondering if anyone who does closings would care to share their
closing fee chart.  Off list??
