Consider approaching manager with a separation proposal.  He gets $XXX in
connection with severance from his role as Manager conditioned on his
vacating within Y days and immediate turnover of all books and records,
along with other terms and conditions protective of both sides.

Otherwise – yes – I feel he can at least argue that he is a tenant and
that tenancy termination requirements must be followed.

Subject: [WSBARP] Landlord/tenant question

 

Listmates:

                Have a very unusual situation.  Landlord has Manager for
apartment complex.  No employment contract.  No lease with manager.
Manager gets free rent in exchange for his services, all verbal.  Landlord
is concerned because of accounting screw ups and missing money that
Manager claims was taken in an early morning robbery.  Plus there are
tenant payments for which tenant has receipt but are not shown in
Manager’s receipt book and for which no money is in the till.  Landlord
wants to fire manager and get him out of the manager’s apartment.

                Do we need to go through the normal eviction process (i.e.
20 day notice to terminate tenancy) in order to get manager out of
manager’s apartment where he has continuing access to records and where
tenants come to pay rent?
