Marc:

 

Washington has no residential construction warranty by either common law
or statute.  So you have to create warranty language.  I believe, but ask
that you check, that the warranty of habitability in Washington only
applies to the first sale of the home from the homebuilder to the first
buyer.  Other than that, nada.

Subject: [WSBARP] New construction warranty

 

I have a client buying a new construction home.  The seller is a couple
who bought and short platted a lot and hired a small builder to construct
new homes on each lot.  Question I have is what steps should we take
regarding warranty liability.  The contract is completely silent on the
issue of warranty.  Neither the sellers or the builder offered any sort of
express warranty or disclaimer of implied warranties.
