[WSBARP] Home Siding Issue

List mates:

 

Client is selling home which was built new in 2008, owned since
completion. Client is in the process of selling home. Client waived
inspection when purchasing home new in 2009. Unbeknownst to client south
wall outside siding (hardi plank) was improperly installed by contractor
after buyers inspection. Inspection revealed no caulking, leaking, and
improper nails which has caused mold and fungus issue. Client has some
bids on repair work, looks like $10,000.00 may be less. But, other
homeowners in same development (same builder) have this issue of
improperly installed siding.

 

Is there any recourse against builder or owner of construction or is this
a maintenance issue?
